Acuerdo de 18 de mayo de 1988, del Pleno del Consejo General del Poder Judicial, por el que se resuelve recurso de reposición interpuesto por don Aníbal Ollero de Sierra y otros, todos ellos Magistrados, contra Acuerdo del Pleno de este Consejo de 28 de julio de 1987, por el que se establecían los criterios aplicables a los Jueces, promovidos a la categoría de Magistrados sin efectividad inmediata de ascenso.
EL PLENO DE ESTE CONSEJO GENERAL DEL PODER JUDICIAL, EN SU REUNION DEL DIA 18 DE MAYO DE 1988, Y RESOLVIENDO EL RECURSO DE REPOSICION NUMERO 184/1987, INTERPUESTO POR DON ANIBAL OLLERO DE SIERRA Y OTROS, CONTRA ACUERDO DEL PLENO DE ESTE CONSEJO GENERAL DE 28 DE JULIO DE 1987, POR EL QUE SE ESTABLECIAN LOS CRITERIOS APLICABLES A LOS JUECES, PROMOVIDOS A LA CATEGORIA DE MAGISTRADOS SIN EFECTIVIDAD INMEDIATA DE ASCENSO, HA ADOPTADO EL SIGUIENTE ACUERDO:
PRIMERO. SE DESESTIMAN LOS RECURSOS DE REPOSICION INTERPUESTOS POR DON EMILIO MERINO LAZAGA Y OTROS, DESTINADOS A OBTENER POR FALTA DE COMPETENCIA LA ANULACION DEL ACUERDO DE 28 DE JULIO DE 1987.
SEGUNDO. SE ESTIMAN EN PARTE LOS RECURSOS DE REPOSICION INTERPUESTOS POR DON ANIBAL OLLERO DE SIERRA Y OTROS CONTRA EL ACUERDO DE 28 DE JULIO DE 1987 Y, EN SU CONSECUENCIA, SE DECLARA QUE LOS JUECES TITULARES DE JUZGADOS DE DISTRITO TIENEN DERECHO, TRANSCURRIDOS DOS AÑOS DESDE SU ASCENSO, A PARTICIPAR EN REGIMEN DE IGUALDAD CON LOS DEMAS MAGISTRADOS EN CUANTOS CONCURSOS DE TRASLADO SE CONVOQUEN.
SE DESESTIMAN EL RESTO DE LAS PRETENSIONES FORMULADAS.
